7. Advertising, marketing, and your communication preferences

You may see different types of Fuelees advertising, and these may not use your personal data – we may buy advertising space in the real world as well as on websites and social media platforms. If you see Fuelees ads on websites or social media, they may not be specifically targeted at you, but we are simply taking advantage of available ad space. We may also use a search engine or similar platforms, which may not be directed at you but can be controlled through the privacy settings of the search engine or social media platforms.

We may use your identity, contact, technical, tracking, usage, and profile data to get an idea of what you might want, need, or be interested in. We do this to decide on the type of products, services, or offers that may interest you and inform you about them. We may carry out direct marketing operations by email, phone, SMS, and postal mail.

On our website, we clearly display your preferences for direct marketing. You can choose to receive our newsletter, or during account creation. We may also send our customers relevant direct marketing offers regarding our products and services, unless they have explicitly opted out of receiving these offers during the purchase process. We may also send you a reminder regarding a purchase if you have left items in your cart without completing the payment.

You have the right to refuse to receive direct marketing offers at any time. The simplest way to notify us of your refusal is by using the unsubscribe link at the bottom of the communication or by simply writing to us at: support@fuelees.fr.

We will ask for your consent before sharing your personal data with an external company for direct marketing purposes. We also work with partners to test and promote the reach of our ads, and we use analytics or retargeting for this purpose. We use Tracking Data to display relevant online ads, including on websites and social media.

Tracking Data, obtained primarily through cookies, helps us provide a website and social media ads that we believe will interest you and potential new Fuelees customers. Cookies used for this purpose are often placed on our website by specialized organizations – which is why, after visiting the Fuelees website, you might see content from our site again. This technique is called 'retargeting’.

Cookies can also tell us if you have viewed a specific ad, and for how long. This information is useful because it allows us to monitor the effectiveness of our ads and how many times users see our ads. Cookies also help us determine if you have opened an advertising email, because we do not want to send you messages that you will not read.

If you want more information about data tracking, including cookies, refer to the 'Cookies' section below. Almost all advertising cookies are part of third-party online advertising networks. If you want to learn how to control the type of ads you see online, check out the opt-out programs provided by the European Interactive Digital Advertising Alliance and the Digital Advertising Alliance (USA). We do not control cookies from advertising networks.

  • Functionality cookies. These cookies allow us to recognize you when you return to our site. They allow us to personalize content for you, greet you by your name, and save your preferences (e.g., your language or region). We will use this information to make our website more relevant based on your interests and for advertising and retargeting purposes. We may also share this information with third parties for this purpose.

We also share data with third parties for advertising, retargeting, and analysis purposes. Please refer to the 'Cookies' section above, including the list of cookies, for more information on how cookies are used in relation to third parties.

We may also share your data with third parties to whom we may decide to sell, transfer, or merge parts of our business or assets. We may also acquire other companies or merge with them. In the event of a change in our business, new owners may use your personal data in accordance with the terms outlined in this Privacy Policy.

11. Data Retention

We will retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, including to comply with any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we take into account the volume, nature, and sensitivity of the data, the potential risks of unauthorized use or disclosure of your personal data, the purposes for which we process your data, and whether we can fulfill those purposes through other means, as well as applicable legal requirements.

The law requires us to keep basic information about our customers (including contact, identity, financial, and transaction data) for six years following the purchase of products or services. We also retain this basic information about our customers for a maximum of seven years following your most recent purchase with us, or to allow us to efficiently handle any after-sales service request. We keep the information you have entered on your customer profile to keep you informed about our latest products, services, and events. We will keep this information until you tell us that you no longer want us to retain it or for a reasonable time after your most recent active interaction with us (e.g., if you opened or clicked on an email we sent you).

14. If you do not provide your personal data

If we need to collect personal data in accordance with the law, or under a contract we have with you, and you do not provide the requested information, we may not be able to fulfill the terms of the contract that binds us or is likely to bind us (for example, to provide you with goods or services). In this case, we may need to cancel the provision of a product or service. However, if this happens, we will notify you.

15. Change of Purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably believe that we need to use it for another reason that is compatible with the original purpose. If we need to use your personal data for other reasons, we will notify you and explain which legal basis allows us to do so. Please note that we may process your personal data without your knowledge or consent, as described above, as long as the law allows or requires it.

In certain circumstances, data protection regulations grant you rights regarding your personal data.

  • Request access to your personal data

This allows you to receive a copy of the personal data we hold about you and check that we are processing it lawfully.

  • Request correction of your personal data

This allows you to have any incomplete or inaccurate data we hold about you corrected, but we may need to verify the accuracy of the new data you provide to us.

  • Request erasure of your personal data

This allows you to ask us to erase or delete personal data when there is no good reason for us to continue processing it. You also have the right to ask us to erase or delete your personal data if you have exercised your right to object to processing (see below), if we have processed your information unlawfully, or if we are required to erase your personal data to comply with local regulations. Please note, however, that we may not be able to fulfill your erasure request due to specific legal reasons, which we will notify you of when applicable.

  • Object to the processing of your personal data

This right allows you to object to the processing of your personal data when we rely on a legitimate interest (or that of a third party) and a particular situation leads you to object to such processing, especially if you believe this processing will impact your fundamental rights and freedoms. You also have the right to object to the processing of your personal data for direct marketing purposes. In certain cases, we can demonstrate that we have compelling legitimate grounds for processing your information, overriding your rights and freedoms.

  • Request restriction of processing your personal data

This allows you to ask us to suspend the processing of your personal data in the following situations: (a) if you want us to verify the accuracy of the data; (b) when our use of the data is unlawful but you do not want us to erase it; (c) when you need us to keep the data even if we no longer need it, in order to establish, exercise, or defend your rights; or (d) when you have objected to us using your data but we need to verify whether we have overriding legitimate grounds to use it.

  • Request the transfer of your personal data

We will provide you, or a third party you choose, with your personal data in a structured, commonly used, and machine-readable format. Please note that this right only applies to automated information that you have initially authorized us to use or that we have used to fulfill the terms of our contract with you.

  • Right to withdraw consent

You can withdraw your consent at any time, as long as we rely on that consent to process your personal data. However, this will not affect the lawfulness of any processing conducted before you withdrew your consent. If you withdraw your consent, we may not be able to provide certain products and services. We will inform you if that is the case at the time you withdraw your consent.

If you wish to exercise any of the rights mentioned above, please refer to the section 'How to contact Fuelees regarding privacy' above.

You will not incur any fees to access your personal data (or to exercise any of your other rights). However, we may charge reasonable fees if your request is clearly unfounded, repetitive, or excessive. We may also refuse your request in such cases.

We may ask you for specific information to help us confirm your identity and ensure your rights to access your personal data (or to exercise any of your rights). This security measure is to ensure that your personal data is not disclosed to individuals who are not authorized to receive it. We may also contact you to request further information about your request in order to respond as quickly as possible.

We aim to respond to all legitimate requests within two (2) months. If your request is particularly complex or if you have several requests, it may take longer. In such cases, we will inform you and keep you updated.

17. Evolution of the Privacy Policy

This Privacy Policy may be modified, supplemented, or updated at any time, particularly to account for any legal, regulatory, jurisprudential, and/or technical developments, in order to ensure the best possible protection of the user's personal data.
